1. Agreement to terms
These Terms & Conditions ("Terms") govern your access to and use of the Precognitaive website, console, APIs, and the Website Assistants product (collectively, the "Services") provided by Precognitaive ("we", "us", "our"). By accessing or using the Services you agree to be bound by these Terms. If you do not agree, do not use the Services.
2. Accounts
You must provide accurate information when creating an account and keep it up to date. You are responsible for safeguarding your credentials and for all activity under your account. Notify us promptly at hello@precognitaive.com of any suspected unauthorized use.
3. Acceptable use
You agree not to misuse the Services. You will not (a) violate any applicable law; (b) infringe intellectual property or privacy rights; (c) upload malicious code; (d) attempt to gain unauthorized access to the Services or related systems; or (e) use the Services to generate or distribute deceptive, harmful, or unlawful content.
4. Customer content
You retain all rights to the content, data, prompts, and materials you submit to the Services ("Customer Content"). You grant us a limited license to host, process, and display Customer Content solely to provide and improve the Services. You represent that you have the rights necessary to submit Customer Content and to allow assistants trained on it to respond to end users.
5. AI outputs
The Services use large language models and may produce inaccurate or incomplete responses. You are responsible for reviewing AI-generated outputs before relying on them and for ensuring they comply with applicable law and your own policies, particularly in regulated industries.
6. Fees
Paid plans are billed according to the pricing communicated at signup or in your order form. Fees are non-refundable except where required by law. We may change pricing with reasonable advance notice.
7. Intellectual property
The Services, including all software, designs, and trademarks, are owned by Precognitaive or its licensors. Except for the limited rights granted in these Terms, no rights are transferred to you.
8. Termination
You may stop using the Services at any time. We may suspend or terminate access if you breach these Terms or if continued provision of the Services would create legal or security risk. Upon termination, your right to use the Services ends; sections that by their nature should survive will survive.
9. Disclaimers
The Services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
10. Limitation of liability
To the maximum extent permitted by law, Precognitaive will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues. Our aggregate liability arising out of or related to the Services will not exceed the amounts paid by you to us in the twelve months preceding the claim.
11. Changes to these terms
We may update these Terms from time to time. Material changes will be communicated through the Services or by email. Continued use after the effective date constitutes acceptance.
